Judge Ibarra of the Third Circuit has struck down the BLNR rule prohibiting people from accessing a large area of Mauna a Wakea during the hours of 10:00 p.m. to 4:00 a.m. Uncle Kalani Flores brought the suit with a special focus on the impact of the rules on faith practitioners.

With the Office of Mauna Kea Management rules withdrawn shortly after the Federal suit was filed by the Kahuna of the Temple of Lono and the most significant part of the BLNR rules now struck down, the Federal case may well settle. A hearing is scheduled in Federal Court in Honolulu on Friday.

The next step should be the Hawai’i Supreme Court striking down the permit issued for the TMT.
